We represent traditional and charter public schools in special education proceedings, data practices questions, student discipline matters, and a wide range of employment issues from discrimination to whistleblower claims. We work with clients on issues involving board governance, Minnesota’s open meeting law, public relations and related issues. Our practice is focused on preventive law whenever possible; we also work closely with our clients to contain the cost of legal services.
Prevention & Training for Schools
The preventive law focus of our practice includes providing in-service training on a wide variety of legal topics including prevention of bullying and harassment, data practices, Section 504, board governance, Minnesota’s open meeting law, employment issues and special education. Please see the Seminars Page for more information
We have successfully represented clients in administrative proceedings as well as in state and federal court matters for over twenty-five years. Our education cases in the areas of special education, choice options and charter schools have helped shape the state of the law in Minnesota.
Our firm has had the privilege to represent clients in appeals to the Minnesota Supreme Court, the Minnesota Court of Appeals, the Eighth Circuit Court of Appeals and the United States Supreme Court.
We draft or review Board policies for our clients regularly. Our lawyers provide Board training on the implementation of the policies as well as create or review employment handbooks that encompass those policies. We also work extensively on student handbooks for our education clients and training and notices regarding the policies incorporated there.
We conduct investigations for government entities, private businesses and nonprofits. Over the course of twenty-five years, we have conducted well over one hundred investigations involving work place misconduct, harassment and discrimination. We operate independently and make every effort to conclude our work quickly and with discretion to assist the client’s efforts to promptly investigate and address claims.
Our investigations have included issues of maltreatment, abuse, theft and embezzlement as well as issues involving student to student harassment and violations of the Minnesota State High School League rules.
We assist our clients with all of their employment law needs, including preparation of employment contracts, including non-compete agreements and other restrictive covenants; collective bargaining, administration of collective bargaining agreements, drafting employee handbooks, and issues arising under the wage and hour law, as well issues stemming from discrimination charges, unemployment compensation, and unfair labor practices; grievance arbitrations, employee discipline and discharge, severance agreements, Minnesota Government Data Practices Act questions, the Minnesota Teacher Continuing Contract Statute, at-will employment questions, employment investigations and matters arising under the Minnesota Veterans’ Preference Act.
